2. Materiale confidenziale
È considerato materiale confidenziale ogni informazione resa disponibile prima, durante o dopo l’accesso al Pitch Deck o ad altri documenti collegati. Rientrano in particolare: pitch deck, business plan, estratti finanziari, modello di business, pricing, roadmap, pipeline commerciale, partner, architettura prodotto, architettura tecnologica, logiche applicative, concept app, competence engine, scoring comportamentale, Strategic Echo Assessment, ONE Mirror Report, academyONE, MneMusique, contenuti Academy, framework, visual, testi, screenshot, mockup, demo, strategie di mercato, know how e qualsiasi informazione non pubblica relativa a Habegger Consulting AG, Mindle o Mindle.ONE.
3. Scopo consentito
Il materiale confidenziale può essere utilizzato esclusivamente per valutare un possibile investimento, finanziamento, mandato di advisory, partnership strategica, collaborazione tecnologica o relazione commerciale autorizzata con Habegger Consulting AG o Mindle.ONE.
4. Obblighi di riservatezza
Il destinatario si impegna a trattare il materiale confidenziale con cura professionale, a non divulgarlo a terzi, a non pubblicarlo, inoltrarlo, copiarlo, registrarlo, fotografarlo, estrarlo, caricarlo su sistemi esterni o utilizzarlo al di fuori dello scopo consentito. La condivisione interna è ammessa solo con persone che hanno una reale necessità di valutazione e sono vincolate da obblighi di riservatezza equivalenti.
5. Divieto di uso competitivo
Il destinatario non può utilizzare il materiale confidenziale per sviluppare, finanziare, consigliare, supportare o far sviluppare prodotti, servizi, piattaforme, assessment, modelli di business, contenuti o sistemi concorrenti o sostanzialmente simili. È vietato ogni uso volto a copiare, imitare, ricostruire, reverse engineer, anticipare o aggirare il progetto Mindle.ONE.
6. Contatti con terzi citati
Eventuali nomi di clienti, partner, prospect, investitori, fornitori, advisor o contatti commerciali indicati nel materiale confidenziale non autorizzano il destinatario a contattarli, sollecitarli o utilizzarli per finalità proprie senza previo consenso scritto di Habegger Consulting AG.
7. Nessuna licenza
L’accesso al materiale confidenziale non concede alcun diritto, licenza, opzione, autorizzazione o titolarità su marchi, contenuti, testi, metodi, know how, software, design, logiche, dati, modelli, documenti o altri diritti di Habegger Consulting AG, Mindle o Mindle.ONE.
8. Durata
Gli obblighi di riservatezza restano validi per cinque anni dalla data di accettazione. Le informazioni che costituiscono know how, segreti commerciali o informazioni strategiche non pubbliche restano protette finché mantengono carattere non pubblico o confidenziale.
9. Restituzione e cancellazione
Su richiesta di Habegger Consulting AG, il destinatario dovrà cancellare o restituire ogni copia del materiale confidenziale, incluse eventuali note, estratti, screenshot, file, stampe o elaborazioni derivate.
10. Nessuna offerta vincolante
Il materiale è fornito a scopo informativo e di valutazione. Non costituisce offerta pubblica, prospetto, consulenza finanziaria, garanzia di risultato, promessa di investimento o impegno contrattuale vincolante, salvo diverso accordo scritto.
11. Tracciabilità e dati personali
I dati inseriti nel modulo vengono utilizzati per gestire la richiesta di accesso, documentare l’accettazione delle presenti condizioni e permettere eventuali comunicazioni relative al progetto. Il trattamento dei dati personali avviene secondo la Privacy Policy disponibile nel footer del sito tramite Iubenda.
12. Rimedi
In caso di violazione, Habegger Consulting AG si riserva il diritto di revocare l’accesso, richiedere la cessazione immediata dell’uso non autorizzato, pretendere la cancellazione del materiale e far valere ogni diritto disponibile, inclusi rimedi cautelari e richieste di risarcimento.
13. Diritto applicabile e foro
Le presenti condizioni sono regolate dal diritto svizzero. Il foro competente è quello della sede di Habegger Consulting AG, salvo fori inderogabili previsti dalla legge.

Die Person, die den Zugang beantragt, sowie eine allfällige Firma, Organisation oder Einheit, für die sie handelt, gilt als Empfängerin der vertraulichen Informationen. Handelt die Empfängerin für eine Organisation, bestätigt sie, dazu berechtigt zu sein, oder übernimmt persönlich die Verantwortung für die Einhaltung dieser Bedingungen.
2. Vertrauliche Unterlagen
Als vertraulich gelten alle Informationen, die vor, während oder nach dem Zugriff auf das Pitch Deck oder damit verbundene Dokumente zugänglich gemacht werden. Dazu gehören insbesondere: Pitch Deck, Business Plan, finanzielle Auszüge, Geschäftsmodell, Pricing, Roadmap, Vertriebspipeline, Partner, Produktarchitektur, technologische Architektur, Applikationslogik, App Konzept, Competence Engine, Behavioural Scoring, Strategic Echo Assessment, ONE Mirror Report, academyONE, MneMusique, Academy Inhalte, Frameworks, Visuals, Texte, Screenshots, Mockups, Demos, Marktstrategien, Know how und alle nicht öffentlichen Informationen zu Habegger Consulting AG, Mindle oder Mindle.ONE.
3. Zulässiger Zweck
Die vertraulichen Unterlagen dürfen ausschliesslich zur Prüfung einer möglichen Investition, Finanzierung, eines Advisory Mandats, einer strategischen Partnerschaft, technologischen Zusammenarbeit oder autorisierten Geschäftsbeziehung mit Habegger Consulting AG oder Mindle.ONE verwendet werden.
4. Vertraulichkeitspflichten
Die Empfängerin verpflichtet sich, die vertraulichen Unterlagen mit professioneller Sorgfalt zu behandeln, sie nicht an Dritte weiterzugeben, nicht zu veröffentlichen, weiterzuleiten, zu kopieren, aufzuzeichnen, zu fotografieren, auszulesen, auf externe Systeme hochzuladen oder ausserhalb des zulässigen Zwecks zu verwenden. Eine interne Weitergabe ist nur an Personen erlaubt, die für die Bewertung tatsächlich beigezogen werden müssen und gleichwertigen Vertraulichkeitspflichten unterstehen.
5. Verbot der wettbewerblichen Nutzung
Die Empfängerin darf die vertraulichen Unterlagen nicht verwenden, um konkurrierende oder im Wesentlichen ähnliche Produkte, Dienstleistungen, Plattformen, Assessments, Geschäftsmodelle, Inhalte oder Systeme zu entwickeln, zu finanzieren, zu beraten, zu unterstützen oder entwickeln zu lassen. Jede Nutzung zum Kopieren, Nachahmen, Rekonstruieren, Reverse Engineering, Vorwegnehmen oder Umgehen des Projekts Mindle.ONE ist untersagt.
6. Kontakte mit genannten Dritten
Allfällige Namen von Kunden, Partnern, Prospects, Investoren, Lieferanten, Advisors oder geschäftlichen Kontakten in den vertraulichen Unterlagen berechtigen die Empfängerin nicht, diese ohne vorherige schriftliche Zustimmung von Habegger Consulting AG zu kontaktieren, anzusprechen oder für eigene Zwecke zu nutzen.
7. Keine Lizenz
Der Zugang zu den vertraulichen Unterlagen gewährt keine Rechte, Lizenzen, Optionen, Bewilligungen oder Eigentumsrechte an Marken, Inhalten, Texten, Methoden, Know how, Software, Design, Logiken, Daten, Modellen, Dokumenten oder sonstigen Rechten von Habegger Consulting AG, Mindle oder Mindle.ONE.
8. Dauer
Die Vertraulichkeitspflichten gelten während fünf Jahren ab Annahme dieser Bedingungen. Informationen, die Know how, Geschäftsgeheimnisse oder nicht öffentliche strategische Informationen darstellen, bleiben geschützt, solange sie nicht öffentlich oder weiterhin vertraulich sind.
9. Rückgabe und Löschung
Auf Verlangen von Habegger Consulting AG muss die Empfängerin jede Kopie der vertraulichen Unterlagen löschen oder zurückgeben, einschliesslich Notizen, Auszüge, Screenshots, Dateien, Ausdrucke oder daraus abgeleitete Bearbeitungen.
10. Kein verbindliches Angebot
Die Unterlagen dienen Informations und Bewertungszwecken. Sie stellen kein öffentliches Angebot, keinen Prospekt, keine Finanzberatung, keine Ergebnisgarantie, kein Investitionsversprechen und keine verbindliche vertragliche Verpflichtung dar, sofern nichts anderes schriftlich vereinbart wurde.
11. Nachvollziehbarkeit und Personendaten
Die im Formular eingegebenen Daten werden verwendet, um die Zugangs Anfrage zu bearbeiten, die Annahme dieser Bedingungen zu dokumentieren und allfällige Kommunikation zum Projekt zu ermöglichen. Die Bearbeitung von Personendaten erfolgt gemäss der im Footer der Website über Iubenda verfügbaren Privacy Policy.
12. Rechtsbehelfe
Bei einer Verletzung behält sich Habegger Consulting AG das Recht vor, den Zugang zu widerrufen, die sofortige Einstellung jeder unautorisierten Nutzung zu verlangen, die Löschung der Unterlagen zu fordern und alle verfügbaren Rechte geltend zu machen, einschliesslich vorsorglicher Massnahmen und Schadenersatzforderungen.
13. Anwendbares Recht und Gerichtsstand
Diese Bedingungen unterstehen schweizerischem Recht. Gerichtsstand ist der Sitz von Habegger Consulting AG, vorbehalten bleiben zwingende gesetzliche Gerichtsstände.

If the recipient acts on behalf of an organisation, they confirm that they are authorised to do so or personally assume responsibility for compliance with these terms.
2. Confidential material
Confidential material includes any information made available before, during or after access to the Pitch Deck or related documents. This includes in particular: pitch deck, business plan, financial extracts, business model, pricing, roadmap, commercial pipeline, partners, product architecture, technology architecture, application logic, app concept, competence engine, behavioural scoring, Strategic Echo Assessment, ONE Mirror Report, academyONE, MneMusique, Academy content, frameworks, visuals, texts, screenshots, mockups, demos, market strategies, know how and any non public information relating to Habegger Consulting AG, Mindle or Mindle.ONE.
3. Permitted purpose
The confidential material may be used solely to evaluate a potential investment, financing, advisory mandate, strategic partnership, technology cooperation or authorised business relationship with Habegger Consulting AG or Mindle.ONE.
4. Confidentiality obligations
The recipient undertakes to treat the confidential material with professional care, not to disclose it to third parties, publish it, forward it, copy it, record it, photograph it, extract it, upload it to external systems or use it outside the permitted purpose. Internal sharing is allowed only with persons who have a genuine need to evaluate the opportunity and are bound by equivalent confidentiality obligations.
5. Prohibition of competitive use
The recipient may not use the confidential material to develop, finance, advise, support or cause the development of competing or substantially similar products, services, platforms, assessments, business models, content or systems. Any use aimed at copying, imitating, reconstructing, reverse engineering, anticipating or circumventing the Mindle.ONE project is prohibited.
6. Contacts with named third parties
Any names of clients, partners, prospects, investors, suppliers, advisors or business contacts mentioned in the confidential material do not authorise the recipient to contact, solicit or use them for their own purposes without the prior written consent of Habegger Consulting AG.
7. No licence
Access to the confidential material grants no right, licence, option, authorisation or ownership in trademarks, content, texts, methods, know how, software, design, logic, data, models, documents or other rights of Habegger Consulting AG, Mindle or Mindle.ONE.
8. Duration
The confidentiality obligations remain valid for five years from the date of acceptance. Information constituting know how, trade secrets or non public strategic information remains protected for as long as it remains non public or confidential.
9. Return and deletion
Upon request by Habegger Consulting AG, the recipient must delete or return every copy of the confidential material, including notes, extracts, screenshots, files, printouts or derivative materials.
10. No binding offer
The material is provided for information and evaluation purposes. It does not constitute a public offer, prospectus, financial advice, guarantee of results, investment promise or binding contractual commitment unless otherwise agreed in writing.
11. Traceability and personal data
The data entered in the form is used to manage the access request, document acceptance of these terms and enable project related communications. Personal data is processed according to the Privacy Policy available in the website footer via Iubenda.
12. Remedies
In case of breach, Habegger Consulting AG reserves the right to revoke access, request the immediate cessation of any unauthorised use, require deletion of the material and enforce any available rights, including injunctive relief and claims for damages.
13. Governing law and jurisdiction
These terms are governed by Swiss law. The competent courts are those at the registered office of Habegger Consulting AG, subject to mandatory statutory venues.

3. Finalité autorisée
Les documents confidentiels peuvent être utilisés uniquement pour évaluer un éventuel investissement, financement, mandat d’advisory, partenariat stratégique, collaboration technologique ou relation commerciale autorisée avec Habegger Consulting AG ou Mindle.ONE.
4. Obligations de confidentialité
Le destinataire s’engage à traiter les documents confidentiels avec un soin professionnel, à ne pas les divulguer à des tiers, les publier, les transférer, les copier, les enregistrer, les photographier, les extraire, les charger sur des systèmes externes ou les utiliser en dehors de la finalité autorisée. Le partage interne est admis uniquement avec des personnes ayant un réel besoin d’évaluation et soumises à des obligations de confidentialité équivalentes.
5. Interdiction d’usage concurrentiel
Le destinataire ne peut pas utiliser les documents confidentiels pour développer, financer, conseiller, soutenir ou faire développer des produits, services, plateformes, assessments, modèles d’affaires, contenus ou systèmes concurrents ou substantiellement similaires. Tout usage visant à copier, imiter, reconstruire, faire du reverse engineering, anticiper ou contourner le projet Mindle.ONE est interdit.
6. Contacts avec des tiers mentionnés
Les noms éventuels de clients, partenaires, prospects, investisseurs, fournisseurs, advisors ou contacts commerciaux mentionnés dans les documents confidentiels n’autorisent pas le destinataire à les contacter, les solliciter ou les utiliser à ses propres fins sans le consentement écrit préalable de Habegger Consulting AG.
7. Aucune licence
L’accès aux documents confidentiels ne confère aucun droit, licence, option, autorisation ou propriété sur les marques, contenus, textes, méthodes, savoir faire, logiciels, designs, logiques, données, modèles, documents ou autres droits de Habegger Consulting AG, Mindle ou Mindle.ONE.
8. Durée
Les obligations de confidentialité restent valables pendant cinq ans à compter de la date d’acceptation. Les informations constituant du savoir faire, des secrets d’affaires ou des informations stratégiques non publiques restent protégées tant qu’elles conservent un caractère non public ou confidentiel.
9. Restitution et suppression
À la demande de Habegger Consulting AG, le destinataire devra supprimer ou restituer toute copie des documents confidentiels, y compris les notes, extraits, captures d’écran, fichiers, impressions ou travaux dérivés.
10. Aucune offre contraignante
Les documents sont fournis à des fins d’information et d’évaluation. Ils ne constituent pas une offre publique, un prospectus, un conseil financier, une garantie de résultat, une promesse d’investissement ou un engagement contractuel contraignant, sauf accord écrit contraire.
11. Traçabilité et données personnelles
Les données saisies dans le formulaire sont utilisées pour gérer la demande d’accès, documenter l’acceptation des présentes conditions et permettre d’éventuelles communications relatives au projet. 12. Mesures en cas de violation

3. Scopo consentito
Il materiale confidenziale può essere utilizzato esclusivamente per valutare un possibile investimento, finanziamento, mandato di advisory, partnership strategica, collaborazione tecnologica o relazione commerciale autorizzata con Habegger Consulting AG o Mindle.ONE.
4. Obblighi di riservatezza
Il destinatario si impegna a trattare il materiale confidenziale con cura professionale, a non divulgarlo a terzi, a non pubblicarlo, inoltrarlo, copiarlo, registrarlo, fotografarlo, estrarlo, caricarlo su sistemi esterni o utilizzarlo al di fuori dello scopo consentito. 5. Divieto di uso competitivo
Il destinatario non può utilizzare il materiale confidenziale per sviluppare, finanziare, consigliare, supportare o far sviluppare prodotti, servizi, piattaforme, assessment, modelli di business, contenuti o sistemi concorrenti o sostanzialmente simili. È vietato ogni uso volto a copiare, imitare, ricostruire, reverse engineer, anticipare o aggirare il progetto Mindle.ONE.
6. Contatti con terzi citati
Eventuali nomi di clienti, partner, prospect, investitori, fornitori, advisor o contatti commerciali indicati nel materiale confidenziale non autorizzano il destinatario a contattarli, sollecitarli o utilizzarli per finalità proprie senza previo consenso scritto di Habegger Consulting AG.
7. Nessuna licenza
L’accesso al materiale confidenziale non concede alcun diritto, licenza, opzione, autorizzazione o titolarità su marchi, contenuti, testi, metodi, know how, software, design, logiche, dati, modelli, documenti o altri diritti di Habegger Consulting AG, Mindle o Mindle.ONE.
8. Durata
Gli obblighi di riservatezza restano validi per cinque anni dalla data di accettazione. Le informazioni che costituiscono know how, segreti commerciali o informazioni strategiche non pubbliche restano protette finché mantengono carattere non pubblico o confidenziale.
9. Restituzione e cancellazione
Su richiesta di Habegger Consulting AG, il destinatario dovrà cancellare o restituire ogni copia del materiale confidenziale, incluse eventuali note, estratti, screenshot, file, stampe o elaborazioni derivate.
10. Nessuna offerta vincolante
Il materiale è fornito a scopo informativo e di valutazione. Non costituisce offerta pubblica, prospetto, consulenza finanziaria, garanzia di risultato, promessa di investimento o impegno contrattuale vincolante, salvo diverso accordo scritto.
11. Tracciabilità e dati personali
I dati inseriti nel modulo vengono utilizzati per gestire la richiesta di accesso, documentare l’accettazione delle presenti condizioni e permettere eventuali comunicazioni relative al progetto. 12. Rimedi

13. Diritto applicabile e foro

2. Vertrauliche Unterlagen
Als vertraulich gelten alle Informationen, die vor, während oder nach dem Zugriff auf das Pitch Deck oder damit verbundene Dokumente zugänglich gemacht werden. Dazu gehören insbesondere: Pitch Deck, Business Plan, finanzielle Auszüge, Geschäftsmodell, Pricing, Roadmap, Vertriebspipeline, Partner, Produktarchitektur, technologische Architektur, Applikationslogik, App Konzept, Competence Engine, Behavioural Scoring, Strategic Echo Assessment, ONE Mirror Report, academyONE, MneMusique, Academy Inhalte, Frameworks, Visuals, Texte, Screenshots, Mockups, Demos, Marktstrategien, Know how und alle nicht öffentlichen Informationen zu Habegger Consulting AG, Mindle oder Mindle.ONE.
3. Zulässiger Zweck
Die vertraulichen Unterlagen dürfen ausschliesslich zur Prüfung einer möglichen Investition, Finanzierung, eines Advisory Mandats, einer strategischen Partnerschaft, technologischen Zusammenarbeit oder autorisierten Geschäftsbeziehung mit Habegger Consulting AG oder Mindle.ONE verwendet werden.
4. Vertraulichkeitspflichten
Die Empfängerin verpflichtet sich, die vertraulichen Unterlagen mit professioneller Sorgfalt zu behandeln, sie nicht an Dritte weiterzugeben, nicht zu veröffentlichen, weiterzuleiten, zu kopieren, aufzuzeichnen, zu fotografieren, auszulesen, auf externe Systeme hochzuladen oder ausserhalb des zulässigen Zwecks zu verwenden. Eine interne Weitergabe ist nur an Personen erlaubt, die für die Bewertung tatsächlich beigezogen werden müssen und gleichwertigen Vertraulichkeitspflichten unterstehen.
5. Verbot der wettbewerblichen Nutzung
Die Empfängerin darf die vertraulichen Unterlagen nicht verwenden, um konkurrierende oder im Wesentlichen ähnliche Produkte, Dienstleistungen, Plattformen, Assessments, Geschäftsmodelle, Inhalte oder Systeme zu entwickeln, zu finanzieren, zu beraten, zu unterstützen oder entwickeln zu lassen. Jede Nutzung zum Kopieren, Nachahmen, Rekonstruieren, Reverse Engineering, Vorwegnehmen oder Umgehen des Projekts Mindle.ONE ist untersagt.
6. Kontakte mit genannten Dritten
Allfällige Namen von Kunden, Partnern, Prospects, Investoren, Lieferanten, Advisors oder geschäftlichen Kontakten in den vertraulichen Unterlagen berechtigen die Empfängerin nicht, diese ohne vorherige schriftliche Zustimmung von Habegger Consulting AG zu kontaktieren, anzusprechen oder für eigene Zwecke zu nutzen.
7. Keine Lizenz
Der Zugang zu den vertraulichen Unterlagen gewährt keine Rechte, Lizenzen, Optionen, Bewilligungen oder Eigentumsrechte an Marken, Inhalten, Texten, Methoden, Know how, Software, Design, Logiken, Daten, Modellen, Dokumenten oder sonstigen Rechten von Habegger Consulting AG, Mindle oder Mindle.ONE.
8. Dauer
Die Vertraulichkeitspflichten gelten während fünf Jahren ab Annahme dieser Bedingungen. Informationen, die Know how, Geschäftsgeheimnisse oder nicht öffentliche strategische Informationen darstellen, bleiben geschützt, solange sie nicht öffentlich oder weiterhin vertraulich sind.
9. Rückgabe und Löschung
Auf Verlangen von Habegger Consulting AG muss die Empfängerin jede Kopie der vertraulichen Unterlagen löschen oder zurückgeben, einschliesslich Notizen, Auszüge, Screenshots, Dateien, Ausdrucke oder daraus abgeleitete Bearbeitungen.
10. Kein verbindliches Angebot
Die Unterlagen dienen Informations und Bewertungszwecken. Sie stellen kein öffentliches Angebot, keinen Prospekt, keine Finanzberatung, keine Ergebnisgarantie, kein Investitionsversprechen und keine verbindliche vertragliche Verpflichtung dar, sofern nichts anderes schriftlich vereinbart wurde.
11. Nachvollziehbarkeit und Personendaten
Die im Formular eingegebenen Daten werden verwendet, um die Zugangs Anfrage zu bearbeiten, die Annahme dieser Bedingungen zu dokumentieren und allfällige Kommunikation zum Projekt zu ermöglichen. 12. Rechtsbehelfe
Bei einer Verletzung behält sich Habegger Consulting AG das Recht vor, den Zugang zu widerrufen, die sofortige Einstellung jeder unautorisierten Nutzung zu verlangen, die Löschung der Unterlagen zu fordern und alle verfügbaren Rechte geltend zu machen, einschliesslich vorsorglicher Massnahmen und Schadenersatzforderungen.

These terms govern access to confidential material made available by Habegger Consulting AG, Switzerland, and the Mindle.ONE project. The person requesting access, together with any company, organisation or entity on whose behalf they act, is considered the recipient of the confidential information. If the recipient acts on behalf of an organisation, they confirm that they are authorised to do so or personally assume responsibility for compliance with these terms.
2. Confidential material
Confidential material includes any information made available before, during or after access to the Pitch Deck or related documents. This includes in particular: pitch deck, business plan, financial extracts, business model, pricing, roadmap, commercial pipeline, partners, product architecture, technology architecture, application logic, app concept, competence engine, behavioural scoring, Strategic Echo Assessment, ONE Mirror Report, academyONE, MneMusique, Academy content, frameworks, visuals, texts, screenshots, mockups, demos, market strategies, know how and any non public information relating to Habegger Consulting AG, Mindle or Mindle.ONE.
3. Permitted purpose
The confidential material may be used solely to evaluate a potential investment, financing, advisory mandate, strategic partnership, technology cooperation or authorised business relationship with Habegger Consulting AG or Mindle.ONE.
4. Confidentiality obligations
The recipient undertakes to treat the confidential material with professional care, not to disclose it to third parties, publish it, forward it, copy it, record it, photograph it, extract it, upload it to external systems or use it outside the permitted purpose. Internal sharing is allowed only with persons who have a genuine need to evaluate the opportunity and are bound by equivalent confidentiality obligations.
5. Prohibition of competitive use
The recipient may not use the confidential material to develop, finance, advise, support or cause the development of competing or substantially similar products, services, platforms, assessments, business models, content or systems. Any use aimed at copying, imitating, reconstructing, reverse engineering, anticipating or circumventing the Mindle.ONE project is prohibited.
6. Contacts with named third parties
Any names of clients, partners, prospects, investors, suppliers, advisors or business contacts mentioned in the confidential material do not authorise the recipient to contact, solicit or use them for their own purposes without the prior written consent of Habegger Consulting AG.
7. No licence
Access to the confidential material grants no right, licence, option, authorisation or ownership in trademarks, content, texts, methods, know how, software, design, logic, data, models, documents or other rights of Habegger Consulting AG, Mindle or Mindle.ONE.
8. Duration
The confidentiality obligations remain valid for five years from the date of acceptance. Information constituting know how, trade secrets or non public strategic information remains protected for as long as it remains non public or confidential.
9. Return and deletion
Upon request by Habegger Consulting AG, the recipient must delete or return every copy of the confidential material, including notes, extracts, screenshots, files, printouts or derivative materials.
10. No binding offer
The material is provided for information and evaluation purposes. It does not constitute a public offer, prospectus, financial advice, guarantee of results, investment promise or binding contractual commitment unless otherwise agreed in writing.
11. Traceability and personal data
The data entered in the form is used to manage the access request, document acceptance of these terms and enable project related communications. Personal data is processed according to the Privacy Policy available in the website footer via Iubenda.
12. Remedies
In case of breach, Habegger Consulting AG reserves the right to revoke access, request the immediate cessation of any unauthorised use, require deletion of the material and enforce any available rights, including injunctive relief and claims for damages.
13. Governing law and jurisdiction
These terms are governed by Swiss law. The competent courts are those at the registered office of Habegger Consulting AG, subject to mandatory statutory venues.

4. Obligations de confidentialité
Le destinataire s’engage à traiter les documents confidentiels avec un soin professionnel, à ne pas les divulguer à des tiers, les publier, les transférer, les copier, les enregistrer, les photographier, les extraire, les charger sur des systèmes externes ou les utiliser en dehors de la finalité autorisée. Le partage interne est admis uniquement avec des personnes ayant un réel besoin d’évaluation et soumises à des obligations de confidentialité équivalentes.
5. Interdiction d’usage concurrentiel
Le destinataire ne peut pas utiliser les documents confidentiels pour développer, financer, conseiller, soutenir ou faire développer des produits, services, plateformes, assessments, modèles d’affaires, contenus ou systèmes concurrents ou substantiellement similaires. Tout usage visant à copier, imiter, reconstruire, faire du reverse engineering, anticiper ou contourner le projet Mindle.ONE est interdit.
6. Contacts avec des tiers mentionnés
Les noms éventuels de clients, partenaires, prospects, investisseurs, fournisseurs, advisors ou contacts commerciaux mentionnés dans les documents confidentiels n’autorisent pas le destinataire à les contacter, les solliciter ou les utiliser à ses propres fins sans le consentement écrit préalable de Habegger Consulting AG.
7. Aucune licence
L’accès aux documents confidentiels ne confère aucun droit, licence, option, autorisation ou propriété sur les marques, contenus, textes, méthodes, savoir faire, logiciels, designs, logiques, données, modèles, documents ou autres droits de Habegger Consulting AG, Mindle ou Mindle.ONE.
8. Durée
Les obligations de confidentialité restent valables pendant cinq ans à compter de la date d’acceptation. Les informations constituant du savoir faire, des secrets d’affaires ou des informations stratégiques non publiques restent protégées tant qu’elles conservent un caractère non public ou confidentiel.
9. Restitution et suppression
À la demande de Habegger Consulting AG, le destinataire devra supprimer ou restituer toute copie des documents confidentiels, y compris les notes, extraits, captures d’écran, fichiers, impressions ou travaux dérivés.
10. Aucune offre contraignante
Les documents sont fournis à des fins d’information et d’évaluation. Ils ne constituent pas une offre publique, un prospectus, un conseil financier, une garantie de résultat, une promesse d’investissement ou un engagement contractuel contraignant, sauf accord écrit contraire.
11. Traçabilité et données personnelles
